UPERGY LIMITED is the personal data controller for your personal information and is also the publisher of the website  www.enix-power-solutions.com.

2. WHY DO WE COLLECT YOUR DATA?

We collect your data for several purposes:

  • Creating your account and managing your orders and the services you request from us, for the delivery of your products or services, processing payments and communicating with you regarding your orders.
  • Managing invoicing and accounting.
  • Carrying out marketing operations and sending advertising by email to those of you who have consented to this: concerning other products offered by our company and products similar to those you have ordered.
  • We also use this information to improve our stores and websites, and to detect fraud or misuse on our websites.

3. Lawfulness of Processing

The processing of your collected data is based on the following legal grounds:

  • Performance of a contract (Article 6(1)b UK GDPR): management of orders, deliveries, invoicing, after-sales service and customer relations. It is specified that customer relations and after-sales service are an extension of the contractual relationship arising from the order.
  • The company’s legitimate interests (Article 6(1)f UK GDPR): sending commercial communications by email concerning products similar to those ordered by customers.
  • Consent (Article 6(1)a UK GDPR): sending commercial communications by email concerning other products.

4. What Personal Data Do We Collect?

Personal data means any information relating to a natural person who may be identified, directly or indirectly.

We collect the following data about you:

  • Identity data: title, surname, first name, address, delivery address, telephone number, e-mail address
  • Order-related information: transaction number, purchase details, purchase amounts, data relating to invoice payment.
  • Payment method data: bank card number, card expiry date, card security code (data immediately deleted)
  • Data required for carrying out marketing actions: email address, telephone number.

5. HOW DO WE COLLECT YOUR DATA?

We collect your personal data when you create an account on our websites or in our stores, when you purchase products on our websites, when you subscribe to our newsletter, and when you visit our websites.

6. WHO ARE THE RECIPIENTS OF YOUR DATA?

Your personal information is intended for certain internal departments. We share this information only in the following cases and for the purposes described in this Privacy Policy, with our group companies, which are either subject to this Privacy Policy or apply rules that are at least as protective as those described in this Privacy Policy.

Third-party service providers: We use other independent companies or individuals who provide certain services on our behalf. Examples include: product delivery, analysis of our databases, provision of marketing assistance, provision of search results and links (including paid links and listings), processing of bank card payments and provision of customer service. Protection of the website and third parties: We disclose the contents of customer accounts and other personal information where we are legally required to do so or where such disclosure is necessary to enforce and apply our General Terms and Conditions of Sale and other agreements, or to protect the rights, property or safety of our websites, users of our websites or other persons.

7. TRANSFERS OUTSIDE THE EU

Certain companies within the UPERGY group are located outside the European Union, in particular in Tunisia. Consequently, your personal data may exceptionally be transferred, for the purposes of certain operations such as customer complaint management and customer review management, to a country outside the European Union.

Furthermore, to ensure the security of your personal data and the lawfulness of such transfers, UPERGY has implemented European Union Standard Contractual Clauses (SCCs) intended to govern data transfers outside the European Economic Area (EEA), in accordance with the General Data Protection Regulation (GDPR).

Where we transfer personal information to a country outside the European Economic Area (EEA) for the purpose of sharing that information as described above, we inform you and ensure that such information is transferred in accordance with this Privacy Policy and in accordance with applicable laws on the protection of personal data.

8. HOW DO WE SECURE YOUR DATA?

All your personal data is strictly confidential and is accessible only to certain members of staff, other companies and subsidiaries of the group, and certain duly authorised service providers.

UPERGY has implemented a combination of physical, logical and organisational security measures to ensure maximum protection of your personal data.

For physical security, we have secure premises using access badges.

For IT and logical security, we use antivirus software, complex passwords in accordance with international standards, access rights by user group and a maximum-security protocol for our digital platforms.

We follow appropriate security procedures when storing your data in order to prevent unauthorised access by third parties and to avoid accidental loss of your data.

Furthermore, we have put procedures in place for handling any personal data breaches.

We also require the persons to whom we transfer your data, in particular our processors and other service providers, to comply with data protection regulations (implementation of data protection clauses).

9. How Long Do We Retain Your Data?

We retain your data for a period appropriate to the various processing purposes and in accordance with the regulations in force.

For customers, we retain the data for the duration of the contractual relationship. Thereafter, certain data may be retained for up to 10 years after the end of the contractual relationship in compliance with accounting and tax obligations.

For marketing purposes, we retain the email address until consent is withdrawn (via the unsubscribe link in our emails) or for 3 years from the last action by the prospect.

For customer complaints, we retain the data for the time necessary to achieve the purpose.

Your data may be used in the context of disputes or litigation for the applicable limitation periods.

The data will then be erased.

10. WHAT ARE YOUR RIGHTS?

  • Right of access This right of access guarantees you access to the personal data collected about you and also allows you to ask for it to be provided to you to verify its content.
  • Right of Rectification You may ask for your personal data to be corrected or completed where it is inaccurate or incomplete.
  • Right to be forgotten (right to erasure) You have the right to ask us to delete your personal data in certain situations, in particular:
    • If your data is used for marketing purposes
    • If your data is no longer necessary for the purposes for which it was collected
    • If you withdraw your consent to the processing of your data.
    • If your data is processed unlawfully.
    • If your data must be erased in order to comply with a legal obligation.

    In the event of a deletion request, we will nevertheless be required to retain certain data in the form of interimediate archiving in order to comply with legal and tax obligations.

  • Right to restriction of processing You have the right to ask us to temporarily freeze the use of certain data, in particuliar while we review your request to exercise another right. It is important to note this right applies only where:

  • Right to data portability You may ask us to transmit your personal data to you or to transmit it to a controller other than UPERGY in the following cases:
    • Where the processing of teh data is based on your consent or is necessary for the performance of a contract
    • Where processing is carried out by automated means.
  • Right to object You may object at any time to the processing of your data for direct marketing purposes. You may object to the processing of your data for direct marketing purposes, in particular by clicking on the unsubscribe link present in all our emails.

11. MINORS

Our products and services are intended for professionals and individuals. Nevertheless, we remind you that we do not collect information from minors under the age of 15 without parental consent or authorisation from the legal guardian.
